Pikes Peak Rotary House Raffle (Revised 2-11-10)

1) Each purchaser of a raffle ticket must be at least 18 years old and only one individual’s name may be associated with each ticket. All federal, state and local rules shall apply to the raffle. Tickets may be purchased only by e-mail. Payments for tickets may only be by credit card, debit card or electronic funds transfer of U.S. funds processed through First Data Corp. Any credit or debit card payment that is denied or any funds transfer that is incomplete or terminated shall disqualify the pending purchase and any ticket issued for such purchase will be disqualified. All ticket sales shall be by the internet at the raffle website www.PikesPeakRotaryRaffle.com. All e-mail communications will be sent to the e-mail address provided by a purchaser as part of the purchase. Such communications shall include purchase confirmation and raffle ticket number. Purchaser is required to provide to the Pikes Peak Rotary Club (“Raffle Sponsor”) a valid, functioning e-mail address and mailing address. The Raffle Sponsor, its processing agent and their respective directors, officers, and members assume no responsibility for incorrect, invalid, terminated or non-functioning e-mail or mailing addresses or lost, incomplete, late, illegible, or undelivered entries or entries without complete, acceptable payment.
2) By submitting an entry, each purchaser acknowledges having read and agreed to abide by these Official Raffle Rules.
3) Once a ticket has been purchased, it is non-refundable except in event the raffle is cancelled in accordance with the raffle regulations of the Colorado Secretary of State. Although a ticket may be transferred, the Raffle Sponsor shall communicate only with the ticket purchaser as shown on its records until proof of the ticket transfer is provided to the Raffle Sponsor. Any transferee of a ticket must be eligible under these Rules in order to win under any drawing. Each ticket is $100 and results in one opportunity to win a raffle prize. Odds of winning depend on the number of tickets sold. To win the house, at least 18,000 tickets must be sold, therefore the odds of winning the house range between 1:18,000 up to 1:26,000 if all tickets are sold. Odds of winning for the Early Drawings are also based on the number of tickets sold by the deadline for each of the Early Drawings.
4) A minimum of 3,000 tickets must be sold for the first tier of prizes to be awarded under the Prize Schedule. If less than 3,000 tickets are sold by the close of the raffle, the only prizes will be the prizes offered through the Early Drawings. A minimum of 18,000 tickets must be sold for the real estate prize to be awarded. Winners will receive the real estate prize or cash prizes based on the Prize Schedule. Note that prize amounts do not increase between intervals; prize amounts are adjusted only when the next tier of ticket sales has been reached. Secondary prizes are reduced once 18,000 tickets have been sold in order to fund the purchase of the real estate prize.
5) If the minimum number of 18,000 tickets is sold, the winner will receive title to the real estate prize, subject to all applicable taxes. Title to the real estate prize will be clear of any mortgages or financing liens, but will be subject to easements of record, and state and local taxes applicable to real estate and to real estate transfers.
6) Each ticket shall be sequentially numbered from the first ticket sold through the last ticket number sold. The maximum number of tickets shall be 26,000. The raffle period shall be from the date the raffle receives final approval from the Colorado Secretary of State’s office, through June 30, 2010, or such earlier date as the maximum number of tickets is sold. The drawing will be held on Friday, July 9, 2010. Ticket purchase deadlines, and drawing dates, times and locations, may be extended or changed at the Raffle Sponsor’s discretion, subject to approval of the Colorado Secretary of State.
7) Early Drawings:
There will be FOUR $10,000 Early Drawings ($10,000 Early Drawing #1, $10,000 Early Drawing #2, $10,000 Early Drawing #3 and $10,000 Early Drawing #4) and FOUR $5,000 Early Drawings ($5,000 Early Drawing #5, $5,000 Early Drawing #6, $5,000 Early Drawing #7, and $5,000 Early Drawing #8) subject to the rules stated below:
a. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, February 24, 2010 shall be eligible for the $10,000 Early Drawing #1 to be held on Friday, February 26, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $4,000; second prize shall be $3,000; third prize shall be $2,000; fourth prize shall be $1,000. A minimum number of 300 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
b. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, March 10, 2010 shall be eligible for the $10,000 Early Drawing #2 to be held on Friday, March 12, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $4,000; second prize shall be $3,000; third prize shall be $2,000; fourth prize shall be $1,000. A minimum number of 400 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
c. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, March 24, 2010 shall be eligible for the $10,000 Early Drawing #3 to be held on Friday, March 26, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $4,000; second prize shall be $3,000; third prize shall be $2,000; fourth prize shall be $1,000. A minimum number of 550 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
d. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, April 7, 2010 shall be eligible for the $10,000 Early Drawing #4 to be held on Friday, April 9, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $4,000; second prize shall be $3,000; third prize shall be $2,000; fourth prize shall be $1,000. A minimum number of 800 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
e. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, April 21, 2010 shall be eligible for the $5,000 Early Drawing #5 to be held on Friday, April 23, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $2,000; second prize shall be $1,500; third prize shall be $1,000; fourth prize shall be $500. A minimum number of 1,100 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
f. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, May 5, 2010 shall be eligible for the $5,000 Early Drawing #6 to be held on Friday, May 7, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $2,000; second prize shall be $1,500; third prize shall be $1,000; fourth prize shall be $500. A minimum number of 1,400 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
g. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, May 19, 2010 shall be eligible for the $5,000 Early Drawing #7 to be held on Friday, May 21, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $2,000; second prize shall be $1,500; third prize shall be $1,000; fourth prize shall be $500. A minimum number of 1,700 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
h. Tickets purchased on or before 11:59:59 pm, Mountain Time, on Wednesday, June 2, 2010 shall be eligible for the $5,000 Early Drawing #8 to be held on Friday, June 4, 2010 at 8:00am at the Woodland Park Public Library, Lower Level, 218 East Midland Ave, Woodland Park, CO. First prize shall be $2,000; second prize shall be $1,500; third prize shall be $1,000; fourth prize shall be $500. A minimum number of 2,000 tickets must be sold in order for this drawing to occur with its corresponding prize to be awarded. The drawing will be cancelled if less than the required number of tickets has been sold.
Early Drawings are subject to all of the other provisions of these rules, specifically including those relating to notification of the winners, eligibility, and payment of taxes. Tickets entered in each early drawing shall be entered in each subsequent early drawing and in the final drawing. Purchasers need not be present at the early drawings to win.
8) Each purchaser will be sent a receipt via e-mail that will identify the purchaser’s unique raffle ticket number. The original raffle ticket will be retained by the Raffle Sponsor. U.S. Postal regulations prohibit the mailing of raffle tickets.
9) At each raffle drawing, raffle ticket numbers shall be chosen through the use of a random number generator restricted to choose from among those raffle ticket numbers issued, thereby guaranteeing winning ticket numbers for each of the prizes to be awarded. The Grand Prize drawing shall take place at 8:00 am MDT on July 9, 2010 at the Lower Level, Woodland Park Library, Woodland Park, CO. Ticket holders do not need to be present at the drawing to win.
10) The holders of the winning tickets from each drawing shall be notified by e-mail and Certified U.S. Mail at the addresses provided by the purchaser. The winning ticket numbers and names of the winners and their respective cities (but not addresses) shall also be placed on the Raffle web site immediately after the drawing.
11) The winning ticket holders from each drawing shall have 30 days from the date of the drawing to notify the Raffle Sponsor in writing of their acceptance of their respective prize. Any winner not claiming their prize within that time frame shall be notified by U.S. certified mail-return receipt requested. Should a winner fail to claim a prize within 30 days after such notification, the prize shall be forfeited by the winner and shall be retained by the Raffle Sponsor. The winner of a prize in any of the drawings shall be required to provide the Raffle Sponsor with a signed statement confirming their eligibility under these Rules and applicable law, proof of age and social security number, and a release confirming the Raffle Sponsor’s use of the winner’s name and likeness in media releases and other publicity.
12) Once the Grand Prize winner has notified the Raffle Sponsor of the winner’s acceptance of the real estate prize, the winner shall have 30 days to satisfy the Raffle Sponsor of the winner’s ability to pay to the Raffle Sponsor the funds required to be withheld for applicable state and federal taxes by either providing evidence of sufficient funds on deposit to pay such taxes or providing a loan commitment in the amount of anticipated taxes. As a general matter, federal income tax can be between 25% to 35% of the value of the raffle prize. Please consult with your own tax advisor. If the winner is unable to pay such taxes to the Raffle Sponsor within such 30 day period, then the Raffle Sponsor may determine the winner ineligible to receive the real estate prize. The Raffle Sponsor’s determination on this matter shall be final. In such event, the Grand Prize winner and the Raffle Sponsor shall split 50:50 the net proceeds from the sale of the real estate prize. The Raffle Sponsor shall have sole discretion and control on the timing and manner of the sale of the real estate prize. If the minimum ticket sales are not achieved and the Grand Prize is cash, the Raffle Sponsor shall withhold applicable state and federal taxes. In either event, and without regard to whether the Raffle Sponsor withholds any taxes, the Grand Prize winner agrees to hold the Raffle Sponsor, its directors, officers, members and agents harmless from any claim arising from the winner’s failure or inability to comply with applicable state and federal tax laws.
13) The Grand Prize (sometimes referred to as the “real estate prize”) consists of the land and home (without furnishings or any personal property) located at 191 Elk Lane, Woodland Park, CO. The real estate prize is under a purchase contract between the property owner and the Raffle Sponsor. Should the minimum number of 18,000 tickets be sold and the real estate be unavailable at the time of the raffle drawing, the Raffle Sponsor reserves the right to pay to the first prize raffle winner the sum of $1,300,000.00 less any required taxes or withholdings. The option to substitute a cash prize for the real estate prize may only be exercised by the Raffle Sponsor. The real estate prize will be awarded in its then present, “as is”, condition without any warranty from the Raffle Sponsor or current property owner as to the condition of the prize other than a warranty of title, subject to matters of record. Ticket Purchasers acknowledge that governmental authorities may place a value on the real estate prize that is different from the value used by the Raffle Sponsor to determine the amount of taxes due. The winner of the real estate prize shall be responsible for all closing costs and fees due to transfer title of the real estate to the winner.
14) The cash prizes will be paid by the Raffle Sponsor promptly after all winners have been confirmed and qualified to receive their respective prizes. Applicable taxes will be withheld from all cash prizes.
15) The winners of the raffle, or of any prizes or awards associated with the raffle, authorize and license the Raffle Sponsor to use their respective names and likenesses in press releases and on the raffle website, and in other promotional materials. The winners are responsible for any and all federal, state or local taxes that may be assessed as a result of winning a prize.
16) Purchasers of tickets by participating in the raffle release the Raffle Sponsor, its directors, officers, members and agents from any and all liability, loss or claim arising out of any raffle prize, expressly waive any such claim and agree that the liability, if any, of the Raffle Sponsor, its directors, officers, members and agents shall be limited to the raffle ticket price paid. In case of any dispute regarding the conduct of the raffle, the decision of the Raffle Sponsor shall be final. The courts of Teller County, Colorado shall have exclusive jurisdiction and venue for any dispute concerning the raffle.
17) Referral Drawings:
The Raffle Sponsor anticipates initiating a referral awards program under which an individual who submits a qualified referral is entered into a special drawing. For the purposes of the Referral Drawings listed below, a “qualified referral” is an individual who has not purchased any tickets as part of this raffle prior to the submission of that same individual as a referral as recorded by the Raffle Sponsor’s email referral system. A minimum of 18,000 raffle tickets must be sold in order for any Referral Drawing prize to be awarded. Availability of the referral awards program will be announced on the raffle website www.pikespeakrotaryraffle.com. If announced, the program will have the following elements:
$13,000 Refer Your Friends Drawing: Each individual who refers a qualified referral who purchases a ticket will receive one entry into the $13,000 Refer Your Friends Drawing for each ticket purchased by the qualified referral. Any and all referrals shall be made through the referral e-mail system to be announced by the Raffle Sponsor in order to qualify for entry into the Referral Drawings. Should two or more individuals refer the same qualified referral, the individual who made the first referral as recorded by the Raffle Sponsor’s referral system shall receive the entry for the qualified referral. All entries must be received before the end of the raffle period as described in the Rules above to be eligible for the $13,000 Refer Your Friends Drawing. The $13,000 Refer Your Friends Drawing will take place on July 9, 2010 in conjunction with the final raffle drawing described above in these Rules. The $13,000 Refer Your Friends Drawing shall be a random drawing from the qualified entries as described herein. First Prize: $10,000.00, Second Prize: $2,000.00 and Third Prize: $1,000.00.
$3,500 Refer The Most Ticket Purchases Drawing: Each individual who refers more than one qualified referral who purchases a ticket will be entered into the $3,500 Refer The Most Ticket Purchases Drawing. Any and all referrals shall be made through the referral e-mail system to be announced by the Raffle Sponsor in order to qualify for entry into the Referral Drawings. Should two or more individuals refer the same qualified referral, the individual who made the first referral as recorded by the Raffle Sponsor’s referral system shall receive credit for the referred individual. The individual who refers the highest number of ticket purchases will be awarded the First Prize of $2,000.00. The individual who refers the second highest number of ticket purchases will be awarded the Second Prize of $1,000.00 and the individual who refers the third highest number of ticket purchases shall be awarded the Third Prize of $500.00. All entries must be received before the end of the raffle period as described in the rules above to be eligible for the $3,500 Refer the Most Ticket Purchases Drawing. The $3,500 Refer the Most Ticket Purchases Drawing will take place July 9, 2010 in conjunction with the final raffle drawing described above in these Rules. The winner of either of the Referral Drawings need not be present to win.
18) Electronic Media Submissions: The Raffle Sponsor may invite persons to submit electronic media submissions (video, photography, drawings, artwork, etc.) addressing various elements of the real estate prize and the raffle. By submitting any electronic media material to the Raffle Sponsor or its marketing partners, and to the extent allowed by law, the person submitting electronic media grants the Raffle Sponsor and its marketing partners the absolute and perpetual right and permission to edit, copy, modify, add to, translate, dub, adapt, publish, exploit, and use the content of and elements embodied in the electronic media submission, in any and all media, including but not limited to digital and electronic media, computer, audio, and audiovisual media, in any language, throughout the world, and in any manner, for any purpose without notice, approval, or compensation. By making an electronic media submission, each person agrees that the Raffle Sponsor and its marketing partners shall have the absolute and perpetual right and permission to use their name, picture, voice, biographical data, photograph, testimonial, or other likeness and/or prize information or personal exposition (and/or any edited portion thereof), and/or any information contained in his/her electronic media submission or entry for promotional, advertising, and/or publicity purposes in any media, in any language, throughout the world, without compensation or notice.
